Term And Conditions

1. Contractual Agreements If you do not agree to these Terms and Conditions, please do not access or use this website or the products or services offered herein.

Welcome to 5 Boro Laundry! These terms and conditions (“Agreement”) apply to 5 Boro Laundry Inc. (“5 Boro Laundry”) website (5borolaundry.com) and the related mobile application and/or selected other domains, existing or future, and related content, products and services (collectively, the “Services”) As used in this Agreement, “5 Boro Laundry,” “we,” “us,” or “our” shall mean 5 Boro Laundry Inc. As a condition of this Agreement, you agree that we may, in our sole discretion, modify this Agreement at any time by providing notice.

That notice may be given (i) by notification through our website or mobile applications or by e-mail, or (ii) by posting a revision to these Terms and Conditions and changing the last updated notice above. Your continued access or use of the Services after such notice or posting constitutes your consent to be bound by the Agreement, as amended. You affirm that you will review this Agreement periodically, so that you are aware of any and all modifications made to this Agreement.

2. Services – 5 Boro Laundry is an on-demand laundry and dry cleaning pick-up & delivery service that allows users to schedule pick-up & delivery using 5 Boro Laundry’s website, via telephone at 718-400-WASH (9274) or email at [email protected]. After scheduling a pick-up, a 5 Boro Laundry staff member will pick-up and deliver the user’s laundry or dry clean to 5 Boro Laundry facilities where it will be cleaned and returned to you.

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES’ CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE SERVICES AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES. Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Services, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

3. Account Information & Notifications – For an active account you must provide to 5 Boro Laundry’s third party cloud software system “Clean Cloud” certain personal information, such as your name, address & phone number, in addition a valid credit card for payment purposes. Please note credit cards will NOT be charged until services have been rendered. Please see Clean Cloud’s privacy page for further information, https://cleancloudapp.com/privacy. It is your responsibility to provide accurate and valid information. Should your information change it can be updated on your profile via 5Borolaundry.com, by contacting a 5 Boro Laundry staff member at [email protected] or by phone at 718-400-WASH (9274). Should inaccurate information be provided, 5 Boro Laundry reserves the right to obtain correct and valid information prior to releasing clothes to its owner. By creating an Account, you agree that 5 Boro Laundry may send you informational text (SMS) messages as part of the normal business operation of your use of the Services. You may opt-out of receiving text (SMS) messages from 5 Boro Laundry at any time by sending a request to [email protected]. You also have the option of notification by e-mail.

4. Minimum Price Requirement for Pick-up & Delivery – The minimum order price is $35 on 5 Boro Laundry’s website and may be updated periodically. Should you require services less than $35; you will automatically be up-charged to meet the minimum $35 requirement. By using our services you are in agreement to this policy. The minimum price requirement applies to both Wash & Fold and Dry Clean items as well as any additional services or products offered by 5 Boro Laundry.

5. Missing / Damaged Items – Missing Items*
If you receive your cleaned clothes and notice missing items, please inform us immediately by calling our customer service team at 718-400-WASH (9274) or by emailing [email protected]. All claims must be reported to our customer service team within five (5) days of the delivery of the order. All claims are reviewed on a case-by-case basis. All decisions on lost items are in 5 Boro Laundry’s sole discretion and are final.

Reimbursement Protocol – For Wash and Fold/Hang Dry, all Dry Cleaning items, laundered shirts including but not limited to bath rugs/ mats, comforters, blankets, duvets, throws, sneakers any reimbursement for an item or order deemed lost by 5 Boro Laundry shall be limited to and shall not exceed ten (10) times the charge for cleaning the lost item (not inclusive of tax and other fees) regardless of brand, price or condition of the garment, or $500, whichever is lower. 5 Boro Laundry’s offer for reimbursement is valid for five (5) business days once the offer is made. Any attempts at redemption beyond that will be evaluated on a case- by-case basis. All decisions on lost items are in 5 Boro Laundry’s sole discretion and are final.

*5 Boro Laundry does not take responsibility for any loose items lost such as watches, jewelry, cuff-links, money, wallets, etc. and shall have no liability for such items.

Damaged Items** – Any damaged items must be reported by calling us at 718-400-WASH (9274) or by emailing us at [email protected] within five (5) days of delivery of the order. Damaged items must be review through digital photos of each damaged item, within five (5) days of delivery of the order. All decisions on damaged items are in 5 Boro Laundry’s sole discretion and are final.

**For damages related to normal wear and tear, 5 Boro Laundry does not provide reimbursement or compensation. Per normal cleaning activity, the following are considered to be normal wear and tear:

  • Shrinkage from repeated laundering
  • Color fading
  • Wear & Tear Holes
  • Discoloration caused by hygiene or beauty products (deodorant, make-up, perfume, cologne)
  • Button damage
  • Hang Dry (Because hang dry items are not being placed in a dryer, we cannot guarantee that the items will return dry. 5 Boro Laundry is not liable for any color running caused by the hang dry process.) Hang Dry items must be separated from Wash & Fold order and properly labeled prior to pick-up (e.g. separate bag containing hang dry items). We are not liable for items that have not been properly labeled.

**5 Boro Laundry is also not liable for damage caused by you selecting the incorrect service when placing an order (e.g. selecting wash and fold instead of dry cleaning, not requesting hang dry service), or when items are sent in incorrect bags (e.g. dry cleaning placed inside a labeled wash and fold bag). 5 Boro Laundry is also not liable for damage caused by, but not limited to loose items like pens and lipstick, chap-stick and or gum. It is advised to check all pockets prior to clothes being picked-up.

Reimbursement Protocol – For any items, regardless of service, deemed damaged outside of the above mentioned exceptions, 5 Boro Laundry may reimburse you by paying up to ten (10) times the charge for cleaning the item (not inclusive of tax and other fees) for which the damage occurred regardless of brand, price or condition of the garment, or $500, whichever is lower. To the fullest extent permitted by law, 5 Boro Laundry’s offer for reimbursement is valid for five (5) business days once the offer is made. Any attempts at redemption beyond that will be evaluated on a case-by-case basis. All decisions on damaged items are in 5 Boro Laundry’s sole discretion and are final.

6. PICK-UP AND DELIVERY – 5 Boro Laundry’s mission is provide quality service to our customers. While we do allow scheduling a pick-up 2 hours ahead on the same day, there is no guarantee the pick-up will be made on time. Therefore, it is strongly advised that pick-up is arranged at least one (1) day in advance. All Wash & Fold items can be returned within 24 hours. However, there is a two day minimum for all dry cleaning items. Rush delivery is available where applicable. Should customers require both Wash & Fold and Dry Clean services, we can deliver items separately at an extra fee. Otherwise, the standard turnaround time is two (2) days for both services. We are aware that not everything goes as planned.

We allow up to one (1) cancellation per month as long as it’s at least one (1) hour prior to pick-up or delivery time. If you cancel a pick-up or delivery less than one (1) hour before your requested time, or if our driver arrives at pick-up or delivery location and the user fails to appear, we may charge a cancellation fee of $13. If your items have already been brought to our facility and the user decides to no longer have the items serviced, there will be a cancellation fee of $13.

We strive to provide a convenient service to all our customers that is why we also provide the option of leaving your clothes with a doorman or outside of your residence, provided the customer gives written consent or indicates on the online scheduling platform. However, once delivery has been made, we will not be held responsible or liable for the loss or damage of any items. It is the customer’s sole responsibility to ensure the safety of items after delivery by 5 Boro Laundry. You have an option to ask us to leave your laundry with the doorman or other location, but 5 Boro Laundry will not be responsible for any lost or damaged items as a result.

TERMINATION OF SERVICES – 5 Boro Laundry reserves the right to terminate any accounts and cancel services if the delivery location is deemed unsafe or inaccessible to our drivers.

7. PAYMENTS – You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in US Dollars. You agree to pay all charges at the prices then in effect for your purchases. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. You consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order. You can cancel your subscription at any time by contacting us using the contact information provided below. We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.

8. MESSAGING – If at any time you wish to stop receiving SMS messages from us, simply reply to the text with “STOP.” You may receive an SMS message confirming you opt out. Please be aware that message and data rates may apply to any SMS messages sent or received. The rates are determined by your carrier and the specifics of your mobile plan.
